Terms and conditions

§ 1 Scope and provider

(1) These terms and conditions apply to all orders placed through this online shop with Ambinoid Cosmetics and Supplements UG (haftungsbeschränkt), Brunnenstraße 187, 10119 Berlin (the „provider“).

(2) The provider sells exclusively to consumers and businesses resident or established in the delivery countries selectable during checkout. The German version of these terms prevails; translations are provided for information only.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By submitting your order you make a binding offer. The provider confirms receipt of the order by email without undue delay. This confirmation of receipt does not yet constitute acceptance.

(3) The contract is concluded once the provider expressly declares acceptance of the order or dispatches the goods.

§ 3 Proof of age

(1) The goods offered are sold exclusively to persons who have reached the age of 18.

(2) By placing an order you confirm that you are of legal age. The provider is entitled to request proof of age and to refuse the order if such proof is not provided.

§ 4 Prices and shipping costs

(1) All prices are final prices in euros and include statutory value added tax.

(2) Shipping costs as shown during checkout apply in addition. Current rates can be found under Shipping and payment.

(3) For deliveries to countries outside the European Union, additional customs duties, import taxes and clearance fees may apply and are borne by the customer.

§ 5 Payment

(1) The payment methods offered during checkout are available. An overview can be found under Shipping and payment.

(2) Where payment is made in advance, the goods are dispatched once payment has been received in full; for card payments, once the payment has been authorised.

§ 6 Delivery

(1) Delivery is made to the delivery address provided by the customer.

(2) Orders placed before 1 pm are dispatched the same day, orders placed later on the next working day. After dispatch, delivery within Germany usually takes 2 to 3 working days, and 3 to 5 working days to Austria and France.

(3) If an item is unavailable, the provider will inform the customer without undue delay and refund any payments already made.

§ 7 Retention of title

The goods remain the property of the provider until payment has been made in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details and the grounds for exclusion are set out in the Right of withdrawal.

§ 9 Warranty

The statutory rights in respect of defects apply.

§ 10 Product information

(1) The shop offers several categories of goods: cosmetics, hemp products sold as aroma and collector items, and smoking accessories and glassware. The category a product belongs to is stated on the product page.

(2) Cosmetics, in particular balms and creams, are intended for external use on the skin. The instructions and the list of ingredients on the packaging apply.

(3) Hemp flowers, hash, extracts, oils and liquids are neither medicinal products nor foodstuffs. They are sold as aroma and collector items and are not intended for consumption.

(4) None of the products offered are medicinal products. No health-related claims are made. The products are not a substitute for medical advice or treatment.

(5) The hemp products offered have a THC content of less than 0.2 %.

(6) Before ordering from abroad, the customer is responsible for checking the import regulations applicable there.

§ 11 Dispute resolution

The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence.

(2) Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
